Privacy Notice

This notice is issued under the Mexican Federal Law on the Protection of Personal Data Held by Private Parties, published in the Federal Official Gazette (Diario Oficial de la Federación) on March 20, 2025. It describes what personal data we process, for what purpose, and how you can exercise your rights regarding it.

Last updated: October 17, 2026

1. Data controller

Eduardo Ángel Montes Martínez, doing business as KOLSEN LEGAL (the “firm”), is the data controller responsible for the personal data you provide through this website, by email, or by any other means of contact. Controller's address: Calle Luis Castro López 373, Upper Floor (Altos), Colonia Nueva, postal code 21100, Mexicali, Baja California, Mexico. Contact email: correspondencia@kolsen-legal.com.

2. Personal data we collect

Through the contact form on this website, by email, and through the communications you send us, we may collect the following data:

  • Identification data: first and last name.
  • Contact data: email address and, where provided, telephone number.
  • Professional data: company, position, and industry.
  • Any information you voluntarily choose to include in the body of your message.

We do not request sensitive personal data through this website. We ask that your first message not include supporting documents, health or financial information, or confidential information about third parties; if such information becomes necessary, we will request it through a secure channel once the engagement has begun.

3. Purposes of processing

We process your data for the following primary purposes, which are necessary for your relationship with the firm:

  • To receive, follow up on, and respond to your inquiry or request.
  • To confirm that there is no conflict of interest before accepting a matter.
  • To prepare and send service proposals and, where applicable, to formalize the engagement.
  • To provide the legal services engaged and to comply with the resulting legal, tax, and accounting obligations.

Your data is not used for any purpose unrelated to your matter.

4. Data transfers

The firm does not sell or trade your personal data. Transfers fall into two categories. First, your consent is not required for the transfers provided for in Article 36 of the Law, including those necessary to maintain or perform the legal relationship you entered into with the firm, those required to defend a right in judicial proceedings, and those provided for by a law or treaty, or necessary or legally required for the investigation of offenses or the administration of justice. Second, the firm discloses your matter to experts, notaries, or correspondent lawyers only with your consent, which you may withhold or withdraw by writing to correspondencia@kolsen-legal.com. Withdrawal has no retroactive effect; if you refuse a transfer that your matter requires, the firm will tell you which part of the service is affected. Every third-party recipient receives this notice and assumes the same obligations as the firm. Technology providers that host this website, receive the messages sent through the form, or provide email services process the data on the firm's behalf, as processors, under their contractual terms; their involvement is not a transfer.

Transfer clause. You indicate whether you accept the transfers that require your consent by ticking or leaving unticked the optional box on the contact form, or by writing to correspondencia@kolsen-legal.com. If you tick the box, you agree that your data may be shared with experts, notaries, or correspondent lawyers when your matter requires it. If you do not tick it, you do not accept those transfers and they will not be made without your prior consent. Your decision does not affect how your inquiry is handled.

5. Data retention

Data relating to prospective clients who do not engage our services is kept only for as long as necessary to handle the inquiry and, where applicable, to document the conflict-of-interest check. Client data is kept for the duration of the relationship and thereafter for the periods required by applicable legal, tax, and professional-liability obligations.

6. Data subject rights and withdrawal of consent

You have the right to access your personal data, to have it rectified if it is inaccurate, to request its cancellation (deletion) when you consider that it is no longer needed for any of the stated purposes, and to object to its processing for specific purposes. You may likewise withdraw any consent you have given us.

To exercise any of these rights, send a request to the email address indicated in section 8, stating your name, how we should send you our response, documents evidencing your identity or your authority to act, a clear description of the data concerned, and any information that helps us locate it. The firm will notify you of its decision within twenty business days of receiving the request and, if the request is found to be valid, will carry it out within fifteen business days of that notice.

Options to limit the use or disclosure of your data. At any time you may refuse or withdraw your consent to transfers and object to your data being processed for any purpose other than your matter, by written request to the email address in section 8 or to the address in section 1. You do not need to give a reason.

7. Browsing data

This website does not use analytics, advertising, or visitor tracking. It stores only your language preference, locally in your browser; this preference is never transmitted to any server and can be removed by clearing your site data. The fonts used to display this website are those already installed on your device: none are downloaded, and the site makes no requests to third-party servers.

8. Contact, designated person, and authority

Requests to exercise these rights and any questions about this notice may be sent to him at correspondencia@kolsen-legal.com or at the address given in section 1. If you believe your request was not properly addressed, you may file a complaint with the Secretaría Anticorrupción y Buen Gobierno (Ministry of Anti-Corruption and Good Government), the competent authority under Article 2, Section XV, and Articles 38 and 39 of the Law.
